I'm guessing a setting is being missed somewhere. The originating broadcaster determines if a program can be re-started or not, and it seems sometimes the switch may not be activated.

That's correct. The Restart feature is sometimes unavailable at the discretion of the broadcaster itself. It's odd that it's occurring only some of the time on CTV (which is indeed on the list of channels that Restart is available on). Is this occurring for any other channel?
It definitely could be set by the broadcaster (for the same reason they prohibit the fast forward feature...you can rewind a program but then you have to watch it all the way through). If it is occurring frequently however then yes a call to our Tech Support team at 1-888-811-2323 may be in order so they can ensure there's nothing wrong with your profile.
